Section 4: User Responsibilities for Online Listings

4.1 Online Posting Requirements

A. Agreement and Information: When purchasing an Online Posting on DIYHomesale.com (the "Website"), you agree to our Posting Terms, select your desired advertising methods, and provide comprehensive and accurate information about your property.

B. Included Materials: Upon purchase of an Online Posting, you will receive one yard sign with a custom phone sticker, one brochure box, and one "Home for Sale" directional sign.

C. Sold Status Update: Upon selling your property, you are responsible for changing the status of the posting to "Sold" on the Website, effectively removing it from public view. DIYHomesale.com may also mark your listing as "Sold" if it determines the property has been sold.

4.2 Yard Sign and Signage Policy

A. DIY Home Sale Sign Placement: The DIY Home Sale property sign must remain installed on your property in a location clearly visible from the street. This applies until the sale has closed or your posting has been cancelled.

B. Exclusive Signage: Only DIY Home Sale branded signage is allowed on the property. No other signage is permitted.

4.3 Pricing and Availability

A. Price Changes: Service and product prices are subject to change. Please refer to your order confirmation for the specific pricing of your chosen package.

B. Promotions and Variations: Prices may vary based on available specials, discounts, or rebates. Additionally, certain services may not be available in all areas.

C. Pricing and Availability Information: For up-to-date pricing and availability information on all services, please visit the "Sell a Home" webpage on DIYHomesale.com.

4.4 Photo/3D Virtual Tour Requirements

A. Property Condition: You are responsible for ensuring your property is in "Show Ready" condition before any scheduled photo or 3D Virtual Open House shoot.

B. Rescheduling Fees: A $30 rescheduling fee plus applicable mileage charges will be applied if a reschedule is needed due to a missed appointment or if the home is not ready for photos or the 3D Virtual Open House. This includes returning to the property to capture additional interior or exterior shots.

C. Cancellation Notice: We understand unforeseen circumstances may necessitate rescheduling. In such cases, please provide at least 24 hours' notice to avoid the rescheduling fee.

D. Pricing and Availability Information: For up-to-date pricing and availability information on photo and 3D Virtual Open House services, please visit the "Sell a Home" webpage on DIYHomesale.com.

4.5 Use of Photos/3D Virtual Tour

All photographs and the 3D Virtual Open House captured by our professional photographers are the property of DIYHomesale.com and are subject to copyright protection. You may not use these photographs or the 3D Virtual Open House in any way without prior written consent from DIYHomesale.com.

4.6 No Real Estate Brokerage Services

DIYHomesale.com does not act as a real estate agent or broker, nor does it maintain a fiduciary relationship with any user. We do not provide specific real estate advice beyond publicly available information. DIYHomesale.com is an innovative advertising and coordination service that connects homeowners with local real estate professionals, including appraisers, inspectors, photographers, and real estate attorneys.

4.7 Cancelling Your Online Posting

To cancel your online posting, please contact your local DIYHomesale.com office. Cancellations are subject to the terms outlined in the separate Cancellation Policy section.

4.8 Removing Your Sold Listing

Upon selling your property, you are encouraged to update the status of your posting to "SOLD" on the DIYHomesale.com website. You can do this by logging in using your username and password, navigating to the drop-down menu in the upper right corner, selecting "Posting Quick Tasks," followed by "Change Posting Status," and then clicking "Mark Sold" and "Submit." This will immediately mark your property as "SOLD" and automatically remove the posting from the website after 30 days.

Section 5: Online Posting Payment

5. Payment Options

Customers who register for an Online Posting on DIYHomesale.com (the "Website") will select one of the following payment options:

Option 2: Payment Plan: Split the advertising fee into two separate payments. The first payment is due upfront at registration, and the second payment is due at the time of sale or closing.
Option 3: Standard Rate at Closing: Pay a single advertising fee at the standard rate due at closing.

All payment options entitle you to maintain the Online Posting until your home is sold.

Additional Fees:

If you choose to purchase additional signs or services, those fees will be collected upfront and are non-refundable.

Section 6: Promotional Programs

6.1 Promotional Programs

6.2 "Receive an Offer or Owe Us Nothing" Program

This Program allows homeowners to list their property on DIYHomesale and receive certain professional services at no upfront cost. These services may include, but are not limited to, a pre-market certified appraisal, pre-market home inspection, professional photography, and a 3D Virtual Open House.

6.2.1 Key Terms and Conditions

Standard market rates for advertising and professional services will become due and payable at closing if a bona fide offer to purchase the property is received within thirty (30) days of the online posting being published on DIYHomesale.com.
An "offer" for purposes of this Program is defined as any written or electronic communication submitted through the DIYHomesale website's online offer system or any other formal offer submitted directly to you, electronically or in person.
If no bona fide offer is received within the thirty (30) day period, no fees will be owed by you, and you may continue to advertise your property on DIYHomesale until it is sold.
Cancelling your listing during the thirty (30) day period will result in a standard market cancellation fee.

6.2.2 Disclaimer

This Program may not be available in all markets. DIYHomesale reserves the right to modify or discontinue this Program at any time.

Section 7: Cancellation Policy

You may cancel your Online Posting at any time by contacting your local DIYHomesale.com office and returning all provided signage.

7.1 Cancellation Fee Waiver

DIYHomesale.com may, at its sole discretion, waive the outstanding Advertising Fee due at closing if:

You pay the applicable cancellation fee as outlined in your Online Posting Agreement.
You have not entered into a purchase agreement or sold the property before or within 45 days of cancellation.

7.2 Failure to Comply

If DIYHomesale.com determines that you entered into a purchase agreement or sold the property before or within 45 days of cancellation, you will be required to pay the remaining Advertising Fee.

7.3 Unpublishing Your Listing

If you unpublish your posting for a period exceeding 14 days, you will be required to pay the cancellation fee and adhere to the terms outlined in this section.

7.4 Credit for Cancellation Fees

Any cancellation fees paid will be applied as a credit towards any outstanding Advertising Fees owed to DIYHomesale.com.

Section 8: Refund Policy

8.1 Limited Refund Policy

DIYHOMESALE, LLC ("DIY Home Sale") maintains a limited refund policy for products and services purchased through its website ("Website"). Refunds will only be issued at DIYHomesale's sole discretion and under the specific circumstances outlined below.

Report the violation to relevant authorities.
IF YOU VIOLATE THIS SECTION, YOU AGREE TO COMPENSATE DIYHOMESALE LLC FOR LIQUIDATED DAMAGES IN THE AMOUNT OF $1,000 PER OCCURRENCE.
